Orders may be cancelled without penalty prior to preparation. Once an order has entered the preparation stage, cancellations may not be possible and charges may apply.

5.5 Promotional Codes and Discounts

Promotional codes, coupons, and discount offers are subject to their individual terms and conditions, including expiration dates and limitations on use. Promotional codes may not be combined with other offers unless expressly stated. We reserve the right to modify or discontinue any promotional offer at any time.

6. Food Allergen and Dietary Information Disclaimer

Jet's Pizza makes reasonable efforts to provide accurate nutritional and allergen information for our menu items. However, our food products are prepared in kitchen environments where allergens including, but not limited to, wheat, gluten, dairy, eggs, soy, nuts, tree nuts, fish, and shellfish are present. Customers with severe food allergies or dietary restrictions are strongly encouraged to consult with our staff before placing an order. Jet's Pizza shall not be liable for any allergic reactions or adverse health effects resulting from the consumption of our products where reasonable allergen disclosures have been made available.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JET'S PIZZA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL THE TOTAL CUMULATIVE LIABILITY OF JET'S PIZZA ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF OUR SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO JET'S PIZZA IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100.00).

The limitations of liability set forth in this section reflect a fair allocation of risk between the parties and are a fundamental element of the basis of the bargain between Jet's Pizza and you. These limitations shall apply notwithstanding any failure of essential purpose of any limited remedy and to the fullest extent permitted under applicable law.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you to the full extent, and our liability will be limited to the greatest extent permitted by applicable law.

8. Disclaimers

8.1 As-Is Basis

OUR SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JET'S PIZZA EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

8.2 No Warranty of Accuracy

We do not warrant that our Site will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected. We do not warrant that the information on our Site is accurate, complete, reliable, current, or free of errors. 9. Indemnification

You agree to defend, indemnify, and hold harmless Jet's Pizza and its officers, directors, employees, agents, subsidiaries, affiliates, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

10. Governing Law and Jurisdiction

The Federal Arbitration Act (9 U.S.C. § 1 et seq.) shall govern the interpretation and enforcement of the arbitration provisions set forth herein.

To the extent that any lawsuit or court proceeding is permitted under these Terms, you and Jet's Pizza agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within the applicable jurisdiction of Jet's Pizza's principal business location. You hereby waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

Nothing in this section shall limit Jet's Pizza's right to seek injunctive or other equitable relief from any court of competent jurisdiction where necessary to prevent irreparable harm pending the resolution of any arbitration or other dispute resolution process.

These Terms shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded.

11. Dispute Resolution

11.1 Informal Resolution

Before initiating any formal dispute resolution process, you agree to contact Jet's Pizza first and attempt to resolve any dispute informally. Please send a written notice of your dispute to [email protected] describing the nature of the dispute and the relief you are seeking. We will attempt to resolve the dispute within thirty (30) days of receipt of your notice.

11.2 Binding Arbitration

If the dispute cannot be resolved informally within thirty (30) days, you and Jet's Pizza agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or to the use of the Services, shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules then in effect. The arbitration shall be conducted in English and the decision of the arbitrator shall be final and binding.

The arbitrator shall have the authority to grant any remedy or relief that would be available in a court of law. The arbitrator's award shall be in writing and shall include the findings of fact and conclusions of law upon which it is based. Judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.

11.3 Class Action Waiver

YOU AND JET'S PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Jet's Pizza agree in writing, no arbitrator or judge may consolidate more than one person's claims or otherwise preside over any form of a representative or class proceeding.

11.4 Exceptions to Arbitration

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights, confidential information, or other proprietary rights. You may also opt out of arbitration within thirty (30) days of first accepting these Terms by sending written notice to [email protected].

11.5 Consumer Protection Rights

Nothing in this dispute resolution section is intended to limit any rights you may have under applicable consumer protection laws, including rights under the Federal Trade Commission Act (15 U.S.C. § 41 et seq.) and applicable state consumer protection statutes.

The failure of Jet's Pizza to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Jet's Pizza.

15. Additional Provisions

15.1 Entire Agreement

Jet's Pizza shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, natural disasters, pandemic or epidemic events, acts of war or terrorism, government actions, labor disputes, power outages, internet disruptions, or supply chain interruptions. In such events, we will make reasonable efforts to notify you and resume normal operations as soon as practicable.

15.4 Assignment

You may not assign or transfer these Terms, or any rights or obligations hereunder, without the prior written consent of Jet's Pizza. Jet's Pizza may freely assign or transfer these Terms without restriction. Any attempted assignment in violation of this provision shall be null and void.

By using our Services, you consent to receive electronic communications from us, including but not limited to order confirmations, receipts, promotional offers (where you have opted in), and notices regarding your account or our Services.
